Who is considered a tax non-resident in Kazakhstan?
You are considered a non-resident under the Double Taxation Avoidance Agreement (DTA), concluded by Kazakhstan, if you do not meet any of the following criteria:
1. Staying in Kazakhstan for 183 days or more during a 12-month period.
2. Investment residency in the International Financial Center "Astana" (IFCA) and staying in Kazakhstan for 90 days or more during a 12-month period.
3. The center of vital interests is located in Kazakhstan, which implies the simultaneous fulfillment of the following conditions:
• Holding Kazakh citizenship or residence permit in Kazakhstan;
• The spouse or close relatives live in Kazakhstan;
• Ownership of real estate in Kazakhstan, accessible for personal use or for the spouse and/or close relatives at any time.
4. Holding Kazakh citizenship, applying for Kazakh citizenship or a residence permit in Kazakhstan while being outside Kazakhstan for one of the following reasons:
• Business trips abroad by government bodies, including diplomats, international organization employees, and their families;
• Working as a member of the crew of a vehicle owned by a legal entity or a citizen of Kazakhstan performing regular international transportation;
• Military or civil service in the military units of Kazakhstan abroad;
• Working on a state-owned facility abroad;
• Studying, internship, medical treatment, or other similar reasons;
• Teaching or scientific activity during the period of such activity.
Are non-residents required to file an income tax declaration (IIT)?
Yes, if you received income from a Kazakhstani source, listed in Article 644 of the Tax Code of the Republic of Kazakhstan, which was not subject to IIT in Kazakhstan at the source of payment. In practice, such income will include, for example, income from securities issued by the Kazakh issuers, as well as income from increase in value upon sale of such securities.
What tax rate applies to non-residents?
• A 15% tax rate applies to non-resident income on the stock market, with some exceptions. A reduced rate or exemption may apply if the non-resident is a tax resident of a country with which Kazakhstan has a DTA.
• If the non-resident is a resident of an offshore jurisdiction, the tax rate increases to 20%.
