What income of a non-resident on the stock market is subject to taxation in Kazakhstan?

• Income from the sale of securities issued by a resident, as well as shares in the authorized capital of a resident legal entity or consortium located in Kazakhstan, if such securities do not meet the criteria for tax exemption in Kazakhstan.
• Shares of a non-resident and shares in the authorized capital of a non-resident legal entity, if 50% or more of the value of these shares, participations, or assets are located in Kazakhstan, and if such shares or participations do not meet the criteria for tax exemption in Kazakhstan.
• Interest (coupons) on debt securities.
• Dividends received from a resident legal entity as well as from Kazakhstani mutual investment funds.
• Income from derivative financial instruments.


What stock market income must a non-resident independently report in their tax declaration?


• Income from the sale of securities sourced in Kazakhstan that is not obtained through a tax agent.
• Income from the sale of derivative financial instruments sourced in Kazakhstan that is not obtained through a tax agent.
• Interest from repo transactions on the exchange, sourced in Kazakhstan that is not obtained through a tax agent.
• Income from operations with derivative financial instruments sourced in Kazakhstan (not obtained through a tax agent).


Important! Taxes on dividends and interest on securities, as well as on income from the sale of securities sourced in Kazakhstan, must be withheld by tax agents. Professional brokers in Kazakhstan are not tax agents.


In the tax declaration, all income that must be declared independently should be reported, even if it is subject to tax exemptions (tax benefits). Tax benefits are applied by excluding exempt income from the total amount of income.
